From registration to enforcement, DELGER IP offers a comprehensive service in all aspects of intellectual property protection in Mongolia.
Registration
Grant decision
According to Art. 8.2 Law of Mongolia on Trade Marks and Geographical Indications, substantive examination should be completed within nine to fifteen months from the application date.
Renewal
A trade mark is protected for ten years from the filing date if the IP Office decided to grant protection. The protection can be renewed indefinitely, for 10 years at a time.
Final refusal decision
If the Examination Unit of the Intellectual Property Office of Mongolia decides not to grant protection, this decision can be appealed to the Dispute Resolution Committee of the Office. The deadline for the appeal is one month from the date of the receipt of the final refusal decision.
Certificate
In case of a national direct registration, keeping the certificate in physical format is recommended. In case of an international registration designating Mongolia, the Intellectual Property Office of Mongolia does not issue a certificate. The certification with the WIPO, digital or physical, should suffice.

A trademark registration is valid for a period of ten years from the date of the national registration. A trademark registration can be renewed every 10 years directly with the Intellectual Property Office of Mongolia (IPOM), upon payment of the required renewal fees.
In case of an enforcement or other issues in Mongolia, the authorities will only accept the ownership on the basis of the registration. This means, the assignment has to be registered with the IP Office to enjoy trademark ownership rights in relation to third parties.
Mongolia is a member of the Trade-Related Aspects of Intellectual Property Rights (TRIPS). The Mongolian intellectual property laws are reformed in 2000s to implement the international standards set by TRIPS.
