Services
Assignment
In case of an enforcement or other issues in Mongolia, the authorities will only accept the ownership on the basis of registration. This means, assignment has to be registered with the IP Office to enjoy trademark ownership rights in relation to third parties.
Formalities
For recordal of assignment, the following documents are required:
- a simple copy of the assignment contract OR an assignment deed signed by both assignor and assignee. An assignment deed form will be provided to you by us. A simple scanned copy of the contract or the assignment deed is sufficient. Notarization or legalization is not necessary.
- a simple copy of a signed power of attorney issued to a local IP agent by the current proprietor of the registered mark. Notarization or legalization is not necessary
- Please note that the IP Office reserves the right to provide more evidence to verify validity of the assignment. In case of a contract, the IP Office may ask us to provide a Mongolian translation of the contract.
Licence
The Trade Mark Law of Mongolia obliges registration of both exclusive and non-exclusive patent and trademark license agreements with the Intellectual Property Office of Mongolia.
Formalities
The following documents are required for registration of a licence agreement with the Intellectual Property Office of Mongolia:
- a power of attorney issued by the licensor to a trade mark agent if the recordal should be arranged by a local agent,
- a notarised copy of the part of the licence contract specifying the scope of the rights licensed.
- a notarised copy of the main licence contract if the licence is issued under a sub-licence (this should be an excerpt of the contract provisions on licensee`s rights on use),
- a Mongolian translation of the licence contract excerpt,
- a power of attorney issued between the licensor or licensee if e.g. the licensee should act as a representative of the licensor in e.g. trade mark enforcement,
- a trade mark licence contract approval notice signed by other co-proprietor(s) of the trade mark to be licensed if only one of the co-proprietor(s) should sign the licence contract.
