Trademarks
In the trademark area, we have successfully represented numerous groundbreaking cases before dispute resolution bodies in Mongolia. These cases include:
- In October 2024, we achieved a significant breakthrough in a trademark infringement case by successfully filing a civil court injunction lawsuit. The first instance civil court of Bayanzurkh district accepted our lawsuit without requiring prior administrative injunction actions by the IP Office of Mongolia. This aligns with Dr. Uyanga Delger’s advocacy for court enforcement of IP rights, as highlighted in her articles published in English and Mongolian.
- In 2023, we successfully represented Atlas Copco, a Swedish multinational industrial company, in a case to invalidate the Mongolian designation of International Registration No. 1596600 for “Atlas Greenair (design)”. Our efforts led to the invalidation of the conflicting registration by the IP Office. This case was a rare instance of successfully challenging the Mongolian designation of an International Registration, and we were instrumental in assisting the IP Office to align its decision with the minimum standards of the Madrid Protocol. - In 2022 and 2023, we led the first-ever non-use and bad-faith cancellation cases in Mongolia on behalf of our US-based clients, following the introduction of these legal provisions by the Mongolia’s Trademark Act of 2021. Our comprehensive filings, which included detailed analyses of legal grounds, evidence, and procedural steps, established a precedent for future trademark enforcement in Mongolia and empowered rights holders to actively protect their trademarks.
- In 2019, we represented Rauch Fruchtsäfte GmbH, an Austrian company, in a Mongolian trademark invalidation case. We successfully challenged the traditional interpretation of trademark law and protected our client’s interests. As a result, the Dispute Resolution Committee of the IP Office invalidated the conflicting mark (No. 40-0018007), even though it was registered in a different class. Our argument focused on the goods being sold and marketed in the same market, which could lead to consumer confusion. This outcome contributed to aligning national trademark law with the minimum standards of the Singapore Treaty on the Law of Trademarks.
